Terms and conditions of use

Modification of Terms

Excelsior Trust New Zealand Limited (Excelsior, we) may from time to time change the terms that govern the use of the Site and recommend  these be reviewed by you, the user or viewer, regularly. Your use of the Site following any such change constitutes your agreement to follow and be bound by the terms as changed. We accept no liability or responsibility as a result of any such changes.

Use of Site

Information to those persons using the Site is for the use of the viewer only and is not to be used for commercial purposes or any other commercial benefit.

Contractual Capacity

The use of the Site and any invitation to use the services of Excelsior is strictly limited to persons who can lawfully enter into and form contracts.

Accuracy of Site Content

Excelsior has endeavoured to ensure that information quoted on the site is correct at the time of publishing, and that all particulars have been fairly described, however Excelsior does not guarantee the accuracy or completeness of information provided and users are advised to make their own enquiries.


Ownership of Rights

All rights, including copyright, in the Site are owned and reserved by Excelsior. Any use of the Site or its contents, including copying or storing it in whole or in part, other than for the user's personal and, non-commercial use is prohibited without the permission of Excelsior.

Submissions

Any feedback or comments between Excelsior and any user are to be treated as a submission to Excelsior. By making any submission to Excelsior ,you the user, are granting Excelsior the absolute right to use the material, ideas, suggestions, concepts or comments and transferring ownership of any rights in the submission to Excelsior. Excelsior is therefore not required to name the user, compensate the user or reward the user in any way, unless required by law.

Communication

You agree that Excelsior may send emails to you for the purpose of advising you of changes or additions to the Site, about any items or services, or for such other purpose(s) as Excelsior deems appropriate.

Limitation of Liability

To the extent permitted by New Zealand law, Excelsior shall not be liable to any customer in any way for any damages arising from the use of the Site. This limitation of liability applies to damages of any kind, including direct, indirect and incidental, loss of income, profit, data, property and claims by third parties.

To the extent permitted by law, Excelsior does not warrant the accuracy or completeness of the content contained in any of the descriptions and particulars on this site and Excelsior shall not be liable for any loss or damage of any kind suffered by the user, including direct, indirect and incidental losses and claims by third parties.

Excelsior will endeavour to ensure the Site will be uninterrupted, timely, secure and free of errors, however we do not accept any liability for any failure to achieve this. We reserve the right to correct any errors and to change or update information at any time without prior notice.

Indemnification

You agree to defend, indemnify and hold Excelsior harmless from and against all actions, claims, damages, costs and expenses, including legal fees, arising from or related to your use of the Site.

Governing Law

This Site, any content contained herein and any Agreement brought into being as a result of usage of the Site are governed by and construed in accordance with New Zealand Law.
